BREAKING: Legal Victory for Makinde as Federal Court Halts EFCC from Probing Oyo State Finances

In what is being described as a monumental victory for the principles of federalism, a Federal High Court has officially restrained the Economic and Financial Crimes Commission (EFCC) from launching a sweeping investigation into the financial records of the Oyo State Government. 


The ruling comes after months of intense political friction. The EFCC had recently signaled its intention to beam its searchlight on the state’s books, specifically targeting local government allocations, security votes, and the awarding of high-profile infrastructure contracts by the Seyi Makinde-led administration. 


However, the Oyo State Government, acting proactively, approached the judiciary to halt the move. 


The Constitutional Argument

Legal representatives for the state argued brilliantly on the premise of the 1999 Constitution (as amended). They submitted that under the principles of true federalism, the EFCC—a federal agency—lacks the constitutional power to bypass the Oyo State House of Assembly and the State Auditor-General to probe the state's treasury. They argued that the state is a federating unit with its own internal mechanisms for financial checks and balances.


The presiding judge agreed with this constitutional interpretation, granting an injunction that temporarily shields the state’s financial books from the anti-graft agency pending the final determination of the substantive suit.


The Political Undertones

While this is a legal victory, the political implications are massive. Political analysts and PDP loyalists in Oyo State have repeatedly accused the opposition All Progressives Congress (APC) of attempting to weaponize federal agencies to harass and distract Governor Makinde ahead of the 2027 general elections. 


For now, the Agodi Government House has successfully outmaneuvered Abuja in the courtroom. However, this legal shield may only be the beginning of a prolonged political chess match between the state and the federal establishment.
